I think that smart phones need a built in function to shut down if they are moving more than 5 mph (walking speed). This would be a function that cannot be turned off. While it would be an inconvenience for passengers and those riding mass transit, it would stop these "accidents" from happening anymore. I put accidents in quotes because if you are purposely using a cell phone while driving, you are just begging to have something like this happen, therefore it isn't really an accident. As a safety expert once said, there are no accidents, at some point someone made a mistake.
